Welcome to Askii.ai! These Terms and Conditions (“Terms”) govern your access to and use of our websites, APIs, software, and services (collectively, the “Service”) provided by Pressingly Networks Inc (“Askii.ai”, “we”, “us”, or “our”).

Please read these Terms carefully. By creating an account, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Service.

1. Definitions

  • “User” or “You”: The individual or entity using the Service.

  • “Third-Party AI Provider”: An independent company that develops and operates its own generative AI models (e.g., OpenAI, Google, Anthropic).

  • “Third-Party Service”: The AI models and related services offered by a Third-Party AI Provider that are accessible through our Service.

  • “Input”: The text, prompts, images, documents, or any other data you provide to the Service.

  • “Output”: The Content (including but not limited to, text, images, code, or any other content) generated and returned by the Service based on your Input.

  • “Content”: Refers to both Input and Output.

2. Eligibility and Account Registration

  • Age Requirement: You must be at least 13 years old to use the Service. If you are under 18, you must have consent from your parent or legal guardian to use the Service.

  • Account Responsibilities: You shall provide accurate and complete information when creating your account for using the Service. You are responsible for securing your account credentials and for all activities that occur under your account, including any costs incurred. You shall notify us immediately of any unauthorized use of your account at legal@askii.ai.

3. Using the Service

  • License Grant: Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Service for your personal or internal business purposes.

  • Prohibited Actions: You shall not:

  • Interfere with or disrupt the normal operation of the Service, our servers, or networks connected to the Service.

  • Attempt to reverse-engineer, decompile, or access the Service’s source code or algorithms.

4. Content Ownership and Responsibilities

  • Use of Third-Party AI Output: Some Output may be generated through third-party AI models whose terms of service may limit or affect your rights to use or commercialize such Output. You are responsible for ensuring that your use of any Output complies with applicable third-party terms.

  • Your Input: You retain ownership of your Input. You grant Askii.ai a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and process your Input solely to provide, maintain and improve the Service.

  • Output Ownership: Subject to your compliance with these Terms, Askii.ai assigns to you all its right to the Output. This means you are free to use the Output for any lawful purpose, including commercial purposes, provided it does not violate any laws or these Terms.

  • AI Training Opt-In: Your Content will not be used to train our generative AI models unless you explicitly opt in through your account settings. Anonymized and aggregated usage data, which does not contain your personal information or specific Input/Output, may be used to improve our Service.

  • Content Responsibility: You are solely responsible for ensuring your Input and the subsequent use of the Output. You must ensure that your Content does not violate any applicable laws or these Terms.

  • Accuracy Disclaimer: Artificial intelligence and machine learning are rapidly evolving fields. The Service may generate Output that is inaccurate, biased, offensive, or incomplete (“hallucinations”). You must independently verify, evaluate the accuracy and appropriateness of any Output before relying on or using it. Askii.ai provides no guarantee as to the accuracy, reliability, or suitability of the Output.

  • Output Similarity: Due to the nature of machine learning, the Service may generate the same or similar Output for you and other users. You acknowledge and agree that content generated for other users is not considered your Output.

5. Acceptable Use Policy

  • You agree not to use the Service to:

  • Engage in any illegal, harmful, or fraudulent activities.

  • Generate, create or disseminate content that is hateful, harassing, defamatory, obscene, or discriminatory.

  • Generate content that depicts or promotes sexual abuse, exploitation of children, or self-harm.

  • Infringe upon, misappropriate, or violate the intellectual property rights of any third party.

  • Generate or distribute malware, viruses, or other malicious code.

  • Generate personally identifiable information that could be used to harm an individual.

  • Attempt to reverse-engineer, decompile, or discover the source code or underlying components of our models, algorithms, and systems.

  • Misrepresent Output as being generated by a human when it is not, or otherwise violate our policies on academic integrity or deceptive practices.

  • Use the Service in a way that could cause harm or injury to any person or property, especially in high-risk domains such as medical diagnosis, legal advice, financial advice, or the operation of critical infrastructure.

  • We reserve the right to suspend or terminate your access to the Service immediately if we believe you are in violation of this policy.

6. Fees and Payment

  • Paid Services: Some parts of the Service may be offered on a subscription or pay-per-use basis. By selecting a paid service, you agree to pay the specified fees.

  • Billing: We will bill you through the payment method linked to your account. All fees are exclusive of applicable taxes, which you are responsible for paying.

  • Refunds: All fees are non-refundable unless required by law or specified in our refund policy that will be published by us from time to time, if any.

7. Privacy and Confidentiality

  • Third-Party Processing of Input Data: Certain Input may be shared with third-party AI providers for processing, solely for the purpose of generating Output. These providers may maintain their own data handling and privacy policies, which may differ from ours. We will not share personally identifiable information (PII) with third-party providers unless it is necessary to deliver the Service and only in accordance with our Privacy Policy. However, if you voluntarily include PII in your Input, we cannot control or prevent its processing by those third-party systems. You are solely responsible for the content you submit to the Service, including any sensitive or personal information.

  • Confidentiality: We will treat your Input as confidential information and only use it in accordance with these Terms.

  • Privacy Policy: Our Privacy Policy explains how we collect, use, and protect your personal information. By using the Service, you agree to the terms of our Privacy Policy.

8. Termination

  • Termination by You: You can stop using the Service and terminate your account at any time.

  • Termination by Us: We may suspend or terminate your access to the Service at our discretion, without notice, if you breach these Terms, if your use poses a security risk, or if we are required to do so by law.

9. Disclaimers and Limitation of Liability

  • Disclaimer of Warranties: THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” TO THE FULLEST EXTENT PERMITTED BY LAW, ASKII.AI DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

  • Limitation of Liability: TO THE FULLEST EXTENT PERMITTED BY LAW, ASKII.AI, ITS AFFILIATES, AND ITS PERSONNEL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR USE OF THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR CONTENT.

  • Maximum Liability: IN NO EVENT SHALL THE AGGREGATE LIABILITY OF ASKII.AI EXCEED THE GREATER OF THE AMOUNT YOU PAID US, IF ANY, IN THE PAST SIX (6) MONTHS FOR THE SERVICE GIVING RISE TO THE CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100).

  • Disclaimer on Third-Party AI Services: Askii.ai may leverage third-party AI services and models, to process user Input and generate Output. The accuracy, reliability, or legality of such Output cannot be guaranteed, and Askii.ai disclaims all responsibility for issues arising from third-party model behavior. By using the Service, you acknowledge and agree that:

  • Output may be generated, in whole or in part, by external AI models not owned by Askii.ai.

  • Such Output may be subject to the terms and policies of the third-party providers, including limitations on reuse or redistribution.

  • Askii.ai is not responsible for errors, omissions, or harmful content generated by such third-party systems.

  • Intellectual property rights in such Output may be limited or shared under the applicable terms of the third-party provider.

10. Indemnification

You agree to defend, indemnify, and hold harmless Askii.ai, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney’s fees, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.

11. Export Control and Sanctions Compliance

You agree not to use the Service in violation of any applicable export control laws or sanctions regulations. You represent that you are not located in, or a citizen of, a country that is subject to sanctions or trade restrictions.

12. Force Majeure

Askii.ai is not liable for delays or failures in providing the Service due to events beyond our control, such as natural disasters, war, cyberattacks, pandemics, or government actions.

12. General Provisions

  • Changes to Terms: We may modify these Terms from time to time. We will provide notice of material changes by posting the updated Terms on our website or by notifying you via email. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

  • Governing Law: These Terms shall be governed by the laws of the State of Delaware, USA, without regard to its conflict of laws principles.

  • Dispute Resolution: Any dispute arising from these Terms will be subject to the exclusive jurisdiction of the competent courts in State of Delaware, United States.

  • Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the Terms will otherwise remain in full force and effect.

  • Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement between you and Askii.ai regarding the Service and supersede all prior agreements.
